Terms of Service

1. Agreement to Terms

By using PiaPearl.com (the “Website”) and its related services (the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and PiaPearl Pty Ltd (“PiaPearl,” “we,” “us,” or “our”). If you do not agree, you must not use our Services.

2. Scope of Services

PiaPearl provides an AI-powered platform that allows customers to design custom dresses. Once a design is finalized, PiaPearl manufactures a bespoke garment (the “Product”) according to the specifications and measurements you provide.

3. AI-Generated Previews

AI-generated images are digital previews only and may include inconsistencies. You acknowledge that: These previews are for concept visualization and may not reflect the final Product exactly. PiaPearl may contact you during the order process to refine and finalize your design before production. Variations in color, drape, or appearance may occur due to fabric texture and craftsmanship.

4. Orders, Deposits, and Payments

A refundable $10 AUD payment is required at checkout to begin the design process. This payment secures your order review. If PiaPearl determines that your requested design cannot be reasonably produced, the $10 AUD will be refunded in full. Once a design is confirmed, the remaining balance is due before production begins. All prices are in AUD unless otherwise stated.

5. Measurements and Sizing

You are solely responsible for providing correct measurements or choosing from our size chart. Minor alterations may still be required for a perfect fit, which are your responsibility. PiaPearl is not liable for incorrect sizing caused by inaccurate measurements submitted by you.

6. Alterations and Credits

PiaPearl does not provide credits for alterations. Credits may only be issued in certain cases, at PiaPearl’s discretion, and must be requested within 7 days of receiving your order.

7. Cancellations, Refunds, and Returns

The initial $10 AUD payment is refundable only if your design is not feasible to produce. Once the final design is approved and production has commenced, the balance paid is generally non-refundable. Partial or full refunds may be issued under limited circumstances, at PiaPearl’s sole discretion (e.g., verified manufacturing defects). Requests must be made within 7 days of delivery, with photographic or written evidence as required. Refunds will not be issued for change of mind, incorrect measurements, or dissatisfaction with stylistic interpretation.

8. Delivery and Risk of Loss

PiaPearl is not responsible for loss or theft of parcels once they have been delivered to the address provided. Title and risk in the Product pass to you upon confirmed delivery by the carrier.

9. Intellectual Property

You purchase ownership of the physical garment only. All intellectual property rights in and to the design concepts, AI-generated previews, and creative styling remain exclusively with PiaPearl. You may not reproduce, copy, or commercialize any design elements beyond personal use of your purchased garment.

10. Limitation of Liability

To the fullest extent permitted by law: PiaPearl shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, business interruption, or reputational loss. PiaPearl’s maximum liability is limited to the total amount paid by you for the specific Product in question.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. Any disputes shall first be attempted to be resolved amicably. Failing that, disputes shall be referred to binding arbitration in Melbourne under the rules of the Australian Centre for International Commercial Arbitration (ACICA).
